1. The particularity of non-residents

A non-resident is both a person living abroad and tax status. You are considered a non-resident when: 
  • You live in another country
  • You work for a company in another country

If you are a non-resident in France, an expatriate, or you want to settle abroad but you have real estate in France, it is important to know how your real estate capital gain is calculated.

2. Real estate capital gains

Real estate capital gain refers to the difference between the final price of the property you just sold and the price you paid to first acquire it.

In essence, it's also the difference between the sale price and the purchase price.

In accordance with the provisions of Article 150 VA of the General Tax Code (CGI), the transfer price to be retained is the actual price as stated on the deed.

Real estate capital gains are taxable for income tax purposes concerning:
  • The sale of real estate (i.e. house, apartment, land),
  • The sale of a right or title attached to real estate (i.e. bare ownership, usufruct, shares in SCI, etc.)
  • The exchange of goods, sharing, or contribution to society
