HOW DOES IT WORK?
Before subscribing to a mandate with the real estate agency, make sure of the scope and extent of the mandate: whether it is exclusive or simple, i.e. whether you entrust the exclusivity of the search to this single agency or if you keep research latitude in parallel.
You will sign a search mandate, allowing you to benefit from the services of a real estate hunter who will put his skills and his network to the benefit of your project.
The real estate agency will do in your name and on your behalf all the necessary steps for the conclusion of a contract.
THE RESEARCH MANDATE
The sales contract allows you to entrust the purchase of your future home to an agent who will find the rare pearl on your behalf.
Also called "purchase mandate"
The agent plays the role of "apartment hunter" who will select the best offers for you. This contract is very framed and makes it possible to guarantee the rights of the purchaser.
The search warrant is a contract between aspiring buyer and a real estate agent.
The agent's mission is to find a property that complies with the buyer's requests. It is regulated by the same legal texts, and the content of the contract is very similar to the sales contract (but it is not).
HOW DOES IT WORK ?
The search mandate must determine the conditions of the real estate transaction, the power delegated to the mandatary, the conditions of the provision of the service, its remuneration and the means used.
In return, the agent will receive a commission, also known as an agency fee. They are only payable if the real estate transaction is actually carried out, after signing the deed of sale at the notary.
As long as the sale is not final, the mandate will not trigger any payment. In particular, visits to real estate (with vouchers) or pre-contract signatures (promise or sales agreement) are not sufficient to justify agency fees.
