REAL ESTATE SALE FILE
To sell your property in France, you need to create a sales file. It contains all of the legal and technical information about your property.
Detailed and organized, it adheres to the ALUR LAW of 2014. And to build a sales file, you need to gather all the important documents necessary for the sale of your property.
I - Personal Information
- Any document confirming your identity is required. This can range from your valid passport to your birth certificate and more. Most importantly, you should also include documents that prove your marital status. This can take the form of your marriage certificate or a civil solidarity pact. As long as it's notarized, then it's valid.
II - Information on co-ownership
Under the ALUR LAW instituted on March 27, 2014, if the property you are selling is under co-ownership, you must submit validation documents when signing the sales agreement. Since the order of August 27, 2015, however, the rule has become more flexible in that you can hand over the documents to the buyer before signing the sales agreement.

A - Sale of a Property Under a Co-Ownership
1. Legal Documents
2. Financial Documents
- Title Deed (Provided by The Notary)
- Document/s that Define Co-Ownership of The Property (Should also state the division of co-ownership and any modifications made within the timeline of ownership).
2. Financial Documents
- Receipts, Invoices, and Bank Statements Issued Regarding the Property (Over The Past Two Years)
- Documents relating to housing loans, home insurance, and the like
- Property Maintenance Books/Logs
- Completed Technical Diagnostics (Dossier de Diagnostic Technique). Under the ELAN Law established back in 2018, the Dossier de Diagnostic Technique (DDT) should include diagnoses of the following:
- Energy Performance
- Lead
- Asbestos
- Electrical Wiring & Installations
- Gas Installation
- Termites
- Pollution
- Noise
- Sanitation (Only for Detached Houses)
B - Sale of a House or Villa
- Title Deed (Provided by The Notary)
- Building Permit
- Documents relating to Modifications Made to The Property
- Boundary Report (If Applicable)
- Document relating to the Easement of The Property (If Applicable)
- Certificate of Subscription of Damage Insurance (If The Work has been Completed for Less than 10 years)
- Equipment Maintenance Contracts (For Boiler, Gas, Septic Tank, etc.)
- Copies of Warranty Certificates (For Equipment with Warranties)
- Documents Related to Rental Lease (i.e. Rental Contract, Rental Receipts, Notice Given to Current Tenant about The Sale)
- Completed Technical Diagnostics (Dossier de Diagnostic Technique). Must include diagnoses of the following:
- Energy Performance
- Lead
- Asbestos
- Electrical Wiring & Installations
- Gas Installation
- Termites
- Pollution
- Noise
- Sanitation (Only for Detached Houses)
Once every requirement is submitted, the notary will take care of compiling all the information and will review each document when signing the authentic deed.
Before signing the deed, a visit to the property is strongly recommended to ensure that everything is in order. And finally, to validate the transfer of ownership with different organizations, the readings of the different meters are also necessary.
