What is the mobility lease "Bail Mobilité"?

The mobility lease "Bail mobilité" is a rental contract proposed by landlords of furnished apartments intended for the temporary rental of accommodation for a period ranging from 1 month to 10 months. This mainly concerns people with a need for mobility, including students, professional transfers and professional missions. 

The mobility lease "bail mobilité" is a rental contract that is not intended to accommodate tourists, but it concerns people with a need for mobility as part of their studies, training or professional mission.

The Mobility Lease "bail mobilité" is therefore a good alternative for owners wishing to rent their furnished homes without committing to a long-term rental in order to have sufficient rental income to cover the costs related to the property such as condominium fees, property tax and maintenance costs. 

What is the furnished lease in tourism?

Furnished tourist accommodation are furnished villas, apartments or studios, for the exclusive use of the tenant, offered for rent to a transient clientele who does not take up residence there and who makes a stay characterized by a rental by the day, week or month (Article L. 324-1-1 of the Tourism Code).

Seasonal or tourist rental is different from a classic housing contract:
  • The tenant does not take up residence there, he resides there mainly for holidays
  • The seasonal rental must be concluded for a maximum period of 90 consecutive days to the same person.

What are the differences between the two? 

  • The duration: a mobility lease "bail mobilité" lasts 1 to 10 months. The duration of a seasonal rental is 90 days maximum for the same tenant, and limited to 120 days per year in some municipalities.
  • Tenants: the mobility lease "bail mobilité" only concerns people in professional mobility, thus excluding tourist rental. The seasonal rental is open to all.
  • The steps: the rental of a dwelling under mobility lease "bail mobilité" does not require any declaration. A seasonal rental must be the subject of a declaration at the town hall, or even an authorization or a request for change of use in the municipalities that put the procedure in place.
  • Rent: the mobility lease "bail mobilité" is concerned by the control of rents in certain areas, unlike seasonal rentals.
  • Qualification: a dwelling on a mobility lease "bail mobilité" can constitute the tenant's main residence and as such, give rise to housing assistance. This is not the case with a seasonal rental.
