Last January, the french government set a law that will gradually decrease thermal screens from the rental market starting in 2023. The future law on climate and resilience, currently being examined by a special parliamentary committee, confirmed this. As a result, F or G-rated apartments will no longer be available for rent by 2028.
Progressive ban on accommodation classified F and G
According to this new law, owners/landlords of energy-intensive properties that are classified as F or G in the DPE (Energy Performance Review) are now forbidden to increase the price of rent upon either extending the term or signing a new lease. This ban will apply starting in 2023. The government aims to make these types of properties disappear from the rental market by 2028.
It's also worth noting that these measures somewhat overlap and coincide with the executive decree announced back in January 2021, which already aims to ban G-rated rental properties by 2023.
Approximately 1.7 million rental units in France were affected (out of approximately 5 million energy-intensive properties), mainly single-family homes in small neighborhoods and apartments built before 1948. The most affected were rural and mountainous areas such as La Nièvre, La Cruz, and Cantal.
How to regularize the standards of the property ... and what funds can be used?
This is the parameter that can most prevent renovations. First, it was proposed that the renovation mandate apply to all energy-intensive properties, not just rental units. But the proposal was rejected by the government, finding it difficult to finance energy renovations for about 5 million homes. Therefore, only owners are concerned by this obligation (at least for now).
The Minister of Housing, Emmanuelle Wargon, has then promised strong measures to support homeowners who have to work (in addition to existing aids such as MaPrimeRenov and the EWC). This issue of funding is very important as it allows 2 million homes to be upgraded by 2028.
Nevertheless, it's also worth noting that some exceptions may be exempt from service obligations. One is a property that is subject to building or monument protection requirements. Another is a property that requires work to reach the threshold but is disproportionate to its real estate value. And finally, if a property owner refuses to carry out the work publicly, they will not be penalized if the work was done privately.
