Can we sell a home whose electricity is not up to standard?

Selling your home, whose electricity is not up to standard, is not prohibited. However, it is important to inform the buyer about the condition of the property. This information will have to be included in a compromise clause listing the anomalies found.

The electricity diagnosis must be annexed to the sales agreement. The electrical anomalies observed will be highlighted in the diagnosis so that the buyer buys in full knowledge of the facts. In the absence of this clause, the buyer could engage the responsibility of the seller for lack of delivery or hidden defects.

Note : If the house or apartment is immediately dangerous, it is not possible to sell the property as it is and it will be necessary to carry out the necessary work to bring the electricity back into compliance.

Is the electrical diagnosis mandatory to sell your home?

The condition of the indoor electricity installation is mandatory in case of sale of a dwelling whose installation is more than 15 years old. This diagnosis must be performed by a certified diagnostician.

When this diagnosis is not provided to the buyer, he may refer the matter to the judicial court, (with or without a lawyer) to have the sale cancelled and possibly claim damages.

When should an electrical diagnosis be performed?

All electrical installations older than 15 years must be inspected by a specialist. This is also the case for outdoor facilities (swimming pools, cabins, etc.).

To proceed with a real estate sale, the electrical balance must be attached to the Technical Diagnostic File which includes:
  • Energy performance reports
  • Risks of exposure to lead
  • The presence of asbestos
  • The status of the gas installation

All these documents are presented to the buyer at the time of signing the sales agreement, it is necessary to carry out the electrical balance at the time of putting his property on the market.

The seller must also tell you if there is a risk of dry rot (fungus) in the construction of the house. This risk of dry rot concerns the geographical areas identified by an order. The decree can be consulted at the prefecture of the department or on its website.

What elements will be inspected during the electrical diagnosis?

To be compliant, an electrical diagnosis must follow the FD C 16-600 quality standard.

The diagnostician will have to inspect:
  • The electrical panel and assert the conformity of the circuit breaker
  • Power outlets
  • Switches
  • The operation of the integrated appliances (dishwasher, hob, etc.)

How to sell your home to a non-compliant electrical installation?

In order to sell your home to the non-compliant electrical installation, it is possible to:
  • Reduce the selling price:
Request a quote from an electrician in order to reduce the sale price by the amount of the latter. Buyers often negotiate the price when they know of the existence of a technical failure.
  • Bring your home up to standard:
The work of upgrading to standards is not mandatory but it can however accelerate a sale. Individuals can apply for aid from ANAH (National Agency for the Improvement of Housing).

To be eligible for ANAH financial aid, you must:
  • Own and be in the modest and very modest resources category (defined by the number of people in the household and tax revenues)
  • Live in the dwelling (principal residence) for at least 6 years after the completion of the renovation work.
  • Renovating a home built at least 15 years ago
  • Have the dwelling evaluated by a professional according to degradation criteria (the dwelling must have a degree of degradation of Anah greater than 0.35)
