How to build a rental file? (Self-employed)


Many owners are cautious when renting out their property to a self-employed entrepreneur, or freelancer. They usually prefer an employee on a permanent contract. Nevertheless, it's possible for the self-employed to rent and sign a lease. Especially to build a rental file in order to seal the deal.

 What are the documents to be provided? 

According to Decree No. 2015-1437 of November 5, 2015, the documents in a self-employed's rental file should include:
  • A valid ID (i.e. passport)
  • Proof of address (i.e. last 3 rent receipts for example)
  • Proof of Employment (i.e. freelance/consultancy employment contract, last 3 payslips, etc.) 
  • A document on the registration of your micro-enterprise: certificate of registration from the SIRENE register (liberal activity), extract K (trader) or extract D1 (craftsman) 
  • Your last tax certificate and turnover certificate for the current year (documents available on the autoentrepreneur.urssaf.fr space)
  • Your last two tax notices
 
Other supporting documents concerning income:
  • For those who work under their self-owned businesses, you'd still need to provide documents that prove your company's financial stability, sustainability, and more. These can include:
  • Long-term service contracts and quotations 
  • The recipe book of your self-owned business 
  • A dashboard of financial management  (i.e. turnover, expenses, net income, cash, forecast, etc.) 
  • Certificate of Rights (CAF)

What documents are not required?

Under the Laws of 6 July 6, 1989, and January 17, 2002, the property owner/landlord has no right to ask for certain documents that are deemed too personal and/or confidential such as:
  • VITALE card
  • Photocopy of bank account
  • Certificate of proper maintenance of the bank account
  • Certificate of no credit, authorization of direct debit
  • Marriage contract or cohabitation certificate
  • Personal medical record
  • Criminal record extract
  • Extract from the family record book
  • Any financial proof intended to reserve or guarantee your accommodation

Is it mandatory to have a guarantor if you are a self-employed entrepreneur?

Most owners/landlords are reluctant to choose self-employed individuals as tenants because their rent guarantees (GLI or Unpaid Rent Guarantee) impose constraints on them. To get around this, you can get a guarantor. They must enter a permanent contract with you and earn income that's at least 3 times the amount of the rent of the property.

The guarantor must provide you with:
  • Their valid ID
  • Their proof of address 
  • Their employment contract
  • Their last 3 payslips
 
However, If you do not have the opportunity to find a guarantor who meets these criteria in your entourage, know that alternative solutions exist. There’s Action Logement's Visale guarantee, for example, which is a rental deposit guaranteeing unpaid rent.  It's reserved for tenants under the age of 30, self-employed individuals, employees of private companies whose net salary is less than or equal to €1,500.00, private sector employees who have transferred to France on business, and tenants who have signed a mobility lease.  
 
If you still cannot benefit from the Visale guarantee, you can use an online guarantor (i.e. Garantme) which allows tenants to self-insure or have a certificate from a bank proving that they can consistently pay their rent.
